1. Definitions

In these Terms:

  • App means the LiveBetterSA web application provided by Us.
  • RCT means the LiveBetterSA randomised controlled trial.
  • Participant means a person who has been enrolled and consented as a participant in the RCT.
  • Participant Materials means the LiveBetterSA Participant Information Sheet and Consent Form
    provided to You.
  • Privacy Statement means the LiveBetterSA Privacy Statement.
  • Cookie Policy means the LiveBetterSA Cookie Policy.
  • Terms means these Terms & Conditions and includes any document incorporated by reference.
  • Third-party Services means services provided by third parties that support the operation of the
    App (for example, SMS delivery services and hosting providers).
  • We, Us or Our means Adelaide University and, where the context requires, its personnel and
    authorised App support service providers involved in operating or maintaining the App.
  • You or Your means the Participant/User agreeing to these Terms.

2. Agreement to these Terms

  1. These Terms set out the basis on which You may access or use the App as a Participant in the RCT. By accessing
    or using the App, You agree to comply with these Terms.
  2. These Terms apply on and from the date You are provided access to the App as an enrolled Participant and
    continue until terminated in accordance with Section 12.

3. Changes to these Terms

  1. We may change these Terms at any time.
  2. Where practicable, We will notify You of any material changes to these Terms using contact details associated
    with your participation.
  3. Updated Terms apply from the date they are published (or otherwise notified). If You continue to access or use
    the App after a change takes effect, You are taken to have agreed to the updated Terms.
  4. If We make changes that materially reduce the App’s functionality or materially affect how You can access or use
    the App, We will use reasonable endeavours to notify You using contact details associated with your participation.

4. Intellectual Property Rights

  1. All copyright and other intellectual property rights in the App, including its design, software, text, graphics,
    and functionality, are owned by Us. Nothing in these Terms transfers ownership of, or grants You any interest in,
    those rights.
  2. We grant You a limited, non-exclusive, non-transferable right to access and use the App for your personal use as
    a Participant in the RCT, in accordance with these Terms.
  3. Nothing in the App grants You any right to use any trademarks, logos, or branding displayed in the App.
  4. Your use of the App is subject to the restrictions in Section 6.

5. Use of the App

You acknowledge and agree that the App is provided for research purposes and to support delivery of the RCT
intervention, and is made available subject to the following conditions:

  1. You may access and use the App only as a Participant and only for your own participation in the RCT.
  2. The App is intended for use by enrolled Participants while located in Australia. You must not access or use the
    App from outside Australia.
  3. You must comply with these Terms and the following documents, which are incorporated by reference:
    1. the Participant Materials;
    2. the Privacy Statement; and
    3. the Cookie Policy
  4. These Terms apply to your use of the App. Your participation in the RCT is governed by the Participant
    Materials, as approved by the University of South Australia Human Research Ethics Committee (which has been
    succeeded by the Adelaide University Human Ethic Committee). If there is any inconsistency between these Terms and
    the Participant Materials in relation to research participation, the Participant Materials will prevail.
  5. How We collect, use, store, and disclose personal information is explained in the Privacy Statement. If there is
    any inconsistency between these Terms and the Privacy Statement in relation to personal information handling, the
    Privacy Statement will prevail.
  6. Any guidance, suggestions, or responses generated through the App’s artificial intelligence chat function are
    provided for general support and research purposes only and are not a substitute for professional advice
    (including medical, health, or psychological advice).
  7. The App is not a medical device and does not provide medical advice, diagnosis, or treatment. The App is not an
    emergency service. If you are experiencing a medical emergency, call 000 (Australia) immediately. If you need
    immediate support for distress, you can also contact Lifeline on 13 11 14. If you have concerns about your health,
    you should seek advice from a qualified health professional.

6. Restrictions on use

  1. You must use the App in a safe and responsible way, and only for your own participation in the RCT. You must
    keep your login details confidential and take reasonable steps to prevent unauthorised access to your account.
  2. In accessing or using the App, You must not do anything that is unlawful, harmful, or interferes with the App or
    its security. In particular, You must not:

    • use the App for any unlawful purpose, or in a way that infringes the intellectual property rights or privacy
      of any person
    • share your access link, one-time code, or account, or allow any other person to access the App using your
      login details
    • attempt to access another person’s account or information
    • attempt to bypass, disable, or interfere with any security or authentication features of the App
    • introduce malware, viruses, spyware, or other malicious code
    • use automated tools (including bots, scraping, bulk downloads, or machine-to-machine methods) to access or
      copy content or data from the App
    • reverse engineer, decompile, or attempt to extract the source code of the App (except where permitted by
      law)
    • use the App in a way that could damage, disable, overload, or impair the App or related systems
    • use the chat function to communicate or store content that is defamatory, harassing, threatening, unlawful,
      pornographic, vulgar, abusive, insulting, inflammatory, offensive, obscene, or otherwise inappropriate or
      objectionable
    • enter identifying personal information (including your own or another person’s) in chat or other free-text
      fields, such as phone numbers, email addresses, home addresses, or social media handles. This does not apply
      to entering your mobile phone number in the designated login field.
    • enter personal, health, or medical information about another person (including names or details that could
      identify them)
    • enter highly sensitive identifiers, for example, Medicare numbers, driver’s licence numbers, passports, or
      financial details
    • interfere with third-party services used to support the operation of the App
  3. Except where permitted by law, You must not copy, reproduce, modify, distribute, publish, or create derivative
    works from any part of the App, or remove any copyright or proprietary notices displayed in the App.
  4. If You breach this section, We may suspend or terminate Your access to the App in accordance with these Terms.
  5. Prompts or requests generated by the App’s artificial intelligence chat function do not change these
    restrictions.

7. Access and login

  1. To access the App, You will be provided with a unique web link. This link is provided to You for your own
    participation in the RCT and must not be shared with anyone else.
  2. To log in, You will be asked to enter your mobile phone number and You will receive a one-time code by SMS. You
    are responsible for:

    1. ensuring the mobile number You provide is accurate and accessible to You;
    2. keeping your one-time code confidential and not sharing it with anyone; and
    3. taking reasonable steps to prevent unauthorised access to your account (for example, by not forwarding
      messages containing login codes and by securing your device).
  3. SMS charges may apply depending on your mobile plan and provider.
  4. If You believe your access link or login process has been compromised, or You receive an SMS code You did not
    request, You must notify Us as soon as practicable at livebettersa@adelaide.edu.au

8. Availability of the App

  1. We will use reasonable endeavours to make the App available to You.
  2. We may temporarily suspend access to the App without notice where emergency maintenance is required or where
    necessary to address security or technical issues.
  3. The App is accessed via the internet. You are responsible for providing and maintaining the device, software,
    and internet access needed to use the App, including ensuring they meet any minimum requirements We notify to You.
  4. You acknowledge and accept that We may utilise third-party services, infrastructure, or platforms to provide the
    App, and We do not control the availability of those third-party services.

9. Third-party services

  1. The App relies on third-party services to support its operation. These services may include:
    1. services used to generate artificial intelligence chat responses; and
    2. services used to deliver SMS messages (including one-time login codes and notifications).
  2. We do not control the operation or availability of third-party services. To the extent permitted by law, We are
    not responsible for any loss or damage arising from a failure or interruption of a third-party service.
  3. Information about third-party services and how personal information is handled is set out in the LiveBetterSA
    Privacy Statement.

10. Data

  1. We collect and use information you provide through the App and technical/usage data generated through your use
    of the App (for example, log and security data) to operate, maintain, secure, and improve the App and to support
    delivery and evaluation of the RCT, including where such technical/usage data is not expressly described in the
    Participant Materials.
  2. We will handle personal information in accordance with the Participant Materials and the Privacy Statement.

11. Disclaimers and limitation of liability

  1. The App is provided on an “as is” and “as available” basis. You acknowledge that the App may be unavailable from
    time to time, may contain errors, and may change during the RCT.
  2. To the extent permitted by law, We are not liable for any indirect or consequential loss, damage, injury, or
    harm arising from Your use of (or inability to use) the App.
  3. Any guidance, suggestions, or responses generated through the App (including by the artificial intelligence chat
    function) are provided for general support and research purposes only and must not be taken as professional
    advice. To the extent permitted by law, We are not liable for any loss, damage, injury, or harm resulting from
    reliance on App content.
  4. Nothing in these Terms excludes, restricts, or modifies any right or remedy You may have under the Australian
    Consumer Law or other applicable law that cannot be excluded, restricted, or modified.

12. Termination

  1. You may stop using the App at any time.
  2. Your access to the App may end when:
    1. your participation in the RCT ends (for example, if you withdraw or are withdrawn); or
    2. the RCT ends and the App is no longer provided to Participants.
  3. We may suspend or terminate Your access to the App (in whole or in part) at any time if We reasonably consider
    it necessary to:

    1. maintain the security or integrity of the App;
    2. respond to suspected unauthorised access, misuse, or a breach of these Terms;
    3. address technical issues, maintenance, or operational requirements; or
    4. comply with applicable law or directions from a regulator or ethics committee.
  4. On termination or suspension, You must cease using the App.
  5. Termination of Your access to the App does not affect how We handle personal information already collected,
    which will be managed in accordance with the Participant Materials and the Privacy Statement.

13. Severance

If any part of these Terms is found to be unlawful or unenforceable, that part will apply only to the extent permitted
by law (or be removed if it cannot be corrected). The rest of these Terms will continue in effect.

14. Governing law

These Terms are governed by the laws of South Australia, Australia. You submit to the non-exclusive jurisdiction of
the courts of South Australia, Australia.

Privacy Statement

1. Introduction

The LiveBetterSA web application (the App) supports delivery of the LiveBetterSA randomised controlled trial (RCT) by
enabling participants (“You”, “Your”) to access App features, including an artificial intelligence (AI) chat function,
and enter information through the App.

This Privacy Statement explains how Adelaide University (“We”, “Us”, “Our”) collects, uses, stores, and discloses
personal information through the App, and through services that support the App.

We handle personal information in accordance with Our privacy Policy (https://adelaideuni.edu.au/about/policies/privacy-policy/).

1.1. Scope of this Privacy Statement

This Privacy Statement applies only to:

  • personal information collected through Your use of the App (including the AI chat function); and
  • personal information handled by App-related service providers on Our behalf (for example, SMS delivery and App
    hosting), to the extent required to operate the App.

This Privacy Statement does not describe privacy practices for research processes that occur outside the App (for
example, study processes conducted by phone, email, or other systems). Those are described in the Participant
Information Sheet and Consent Form (Participant Materials).

1.2. Service providers

We use third-party service providers to support the operation of the App.

  1. App maintenance and support providers (for example, the software developers supporting the App during the RCT)
    may access limited information on Our behalf where necessary to operate, maintain, secure, or troubleshoot the
    App, and are subject to confidentiality and security obligations.
  2. The App also relies on external technology services to enable certain functions (for example, SMS delivery and
    generation of AI responses). These services may process information as required to provide those functions. The
    App is designed to minimise the use and sharing of identifying information in connection with these services.

We take reasonable steps to ensure service providers are subject to appropriate privacy and security obligations.

2. Information needed to use the App

To access the App, You will be provided with a unique web link.

To log in, You will be asked to enter Your mobile phone number, and You will receive a one-time code by SMS. SMS
charges may apply depending on Your mobile plan and provider.

3. Security of Your personal information

We take reasonable steps to protect personal information collected through the App from misuse, interference, loss,
unauthorised access, modification, or disclosure. Measures may include access controls, audit logs, and security
monitoring.

No system can guarantee complete security. Information sent over the internet (including through web applications and
email) may carry inherent risks.

3.1. If You think Your security has been compromised

If You think Your access link has been shared, Your account has been accessed by someone else, or You receive a
one-time SMS code You did not request, contact Us using the details in section 9.

4. Personal information collected through the App

Depending on how You use the App, We may collect:

  • Login and account information: mobile phone number (for one-time SMS login codes), and first
    name (if You provide it in the App)
  • Information You enter in the App: any text or responses you submit through App features,
    including messages you type into the AI chat function and any entries you make in forms within the App. This may
    include information you choose to provide through the App for lifestyle coaching and progress tracking (for
    example, user profile details used within the App, lifestyle goals, progress updates, and related health or
    wellbeing information).
  • Technical and usage information: log and security data, device and browser information, and
    information about how You interact with the App.

5. How We use App information

We collect and use personal information through the App to:

  • provide access to the App and its features (including SMS one-time code login)
  • operate, maintain, secure, and improve the App (including troubleshooting and quality assurance)
  • monitor App performance and manage misuse or security incidents
  • administer App access for participants (for example, enabling or disabling access)
  • support research analysis and reporting using information collected through the App, consistent with the
    Participant Materials (including where de-identification or aggregation is used).

5.1. AI chat function

The App includes a chat function that generates responses using OpenAI, accessed via Our OpenAI environment.

What information is sent for chat processing

When You use the chat function, information is transmitted for the purpose of generating an AI response. This may
include:

  • current chat messages
  • chat history
  • onboarding responses
  • goals
  • progress summaries
  • technical information necessary to support the service (for example, timestamps or session/security
    information).

Identifying information

We take reasonable steps to minimise directly identifying information sent to OpenAI. During onboarding, the App asks
for your name. The name you provide is stored to your account and is pseudonymised (hashed) before any information is
sent to OpenAI. If You type Your name (or other identifying information such as phone numbers, email addresses, or
home addresses) into chat outside the designated onboarding field, that information may be transmitted to OpenAI as
part of chat processing.

Service providers and processing chain

OpenAI may use its own service providers (sometimes referred to as subprocessors) to support delivery of its services.
We take reasonable steps to ensure appropriate privacy and security arrangements are in place for the use of OpenAI
via Our Open AI environment.

Data retention and model training

We have configured Our OpenAI environment so that information sent to OpenAI is not used to train OpenAI’s models.
OpenAI may retain certain data for abuse monitoring and safety purposes for up to 30 days, in accordance with its API
data controls.

Authorised access

Chat messages and conversation logs may be accessed by authorised personnel:

  • for App administration purposes (for example, troubleshooting, quality assurance, and safety monitoring of the
    App); and
  • for research analysis and reporting, consistent with the Participant Materials (including where
    de-identification or aggregation is used).

6. Disclosure of App personal information

We may disclose personal information collected through the App in limited circumstances, including:

  • to authorised personnel at Adelaide University who support operation and administration of the App
  • to App maintenance and support providers (for example, the software developers supporting the App during the
    RCT), where necessary to operate, maintain, secure, or troubleshoot the App, and subject to appropriate
    confidentiality and security obligations
  • to technology service providers that support operation of the App (for example, hosting, security monitoring,
    SMS delivery, and AI response generation), where necessary for the App to function and subject to appropriate
    privacy and security obligations
  • where required or authorised by law.

We do not otherwise disclose Your personal information to third parties except as described in this Privacy Statement
or in accordance with Our Privacy Policy.

6.1. Overseas disclosures

Some technology service providers that support the App may process information using infrastructure located outside
Australia. Where this occurs, We take reasonable steps to ensure appropriate privacy and security arrangements are in
place.

7. Retention of App information

We retain personal information collected through the App for as long as needed to operate the App and meet applicable
governance and recordkeeping requirements, consistent with the Participant Materials where applicable.

8. Access and correction

You may request access to, or correction of, personal information We hold about You that was collected through the
App, subject to any applicable legal exceptions.

You may escalate Your complaint to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au if You are not satisfied with Our response.

1. Introduction

The LiveBetterSA web application (the App) uses cookies and similar technologies to support core functionality,
security, and performance.

This Cookie Policy explains what cookies are, how We use them in the App, and how participants (“You”, “Your”) can
manage them.

2. Information about Us

The App is owned and operated by Adelaide University (“We”, “Us”).

3. How the App uses cookies

Cookies are small text files or pieces of information that are stored on Your computer or mobile device when You use a
website or web-based application. A cookie may contain the name of the website it came from, how long it will remain
on Your device, and a value (often a randomly generated unique identifier).

We use cookies to support the operation of the LiveBetterSA web application (the App), including to:

  • keep the App working securely (for example, maintaining a secure session)
  • help prevent unauthorised access and detect suspicious activity
  • track login activity and technical usage data (for example, session activity and feature usage) to help Us
    operate and improve the App
  • troubleshoot and improve performance (for example, error logging)

Cookies may be set by Us (first-party cookies) or by third-party services We use to operate the App (third-party
cookies).

If any data collected through cookies is personal information under applicable law, it will be handled in accordance
with the LiveBetterSA Privacy Statement and Our Privacy Policy (https://adelaideuni.edu.au/about/policies/privacy-policy/).

4. Types of cookies We use

4.1. Strictly necessary cookies

These cookies are essential for the App to function properly. They enable features such as secure login, session
management, and form submissions. Without these cookies, the App cannot operate as intended. These cookies are
required for the App to operate. If You block cookies in Your browser, the App may not function properly.

4.2. Performance and security cookies

These cookies help Us understand how the App performs and is used and help Us keep it secure. This may include
information about:

  • login and session activity
  • security events (for example, unusual login attempts)
  • technical usage data (for example, feature usage and timestamps)
  • error and performance logs

4.3. Functional cookies (if used)

Functional cookies allow the App to remember certain choices You make (for example, preferences or settings). If You
disable these cookies, some features may not remember Your preferences or behave as expected.

4.4. Targeting cookies

We do not use targeting or advertising cookies in the App.

5. Managing cookies

You can manage cookies through Your browser settings. Depending on Your browser, You may be able to:

  • delete existing cookies
  • block some or all cookies
  • block third-party cookies
  • receive a notification when cookies are being used

Please be aware that if cookies are disabled or removed, some features of the App may operate as intended (including
login and secure session features). If You use different devices or browsers to access the App, You will need to
adjust settings on each device/browser.
